This bill amends the Fair Credit Reporting Act to prevent consumer reporting agencies from including negative information in credit reports that resulted from a consumer being unlawfully or wrongfully detained abroad or held hostage abroad.
Sec. 2, Adverse information about consumers unlawfully or wrongfully detained abroad or held hostage abroad: This section defines a "covered consumer" as a U.S. national determined to have been unlawfully or wrongfully detained abroad under the Robert Levinson Hostage Recovery and Hostage-Taking Accountability Act, or a U.S. national taken hostage abroad as determined by the Hostage Recovery Fusion Cell. It also defines "detention or hostage documentation" as documentation certifying the consumer's status, identifying the detention period, and authenticated by the Special Presidential Envoy for Hostage Affairs or the Hostage Recovery Fusion Cell. If a consumer reporting agency can authenticate such documentation provided by a covered consumer, it may not furnish a consumer report containing any adverse item of information about that consumer dating from the time period of the detention or hostage situation.
