Summary

The Stop CARB Act of 2024 amends the Clean Air Act to eliminate the ability of the Environmental Protection Agency (EPA) to grant waivers allowing California to set its own motor vehicle emission standards, and also repeals the authorization for other states to adopt California's standards. It removes key provisions that have allowed California and other states to enforce stricter vehicle emissions rules than federal ones.

Sec. 2, Repeal of waivers of state standards: This section strikes subsection (b) of Clean Air Act section 209, which allowed the EPA to waive federal preemption for California's emission standards. It also removes related language in other subsections and makes conforming changes throughout the Act. Any existing waivers issued under that subsection are voided, and any pending waiver applications are considered denied as of the date of enactment.

Sec. 3, Repeal of authorization to use California new motor vehicle emission standards: This section repeals Clean Air Act section 177, which had permitted other states to adopt California's stricter motor vehicle emission standards. It also makes a conforming amendment to section 249(e)(3) of the Act.
