Summary

This bill amends the Indian Tribal Justice Act to expedite new Tribal court assessments and base support funding, and requires a report on barriers to Tribal justice services. Sec. 2, Indian Tribal Justice Act Amendments: This section adds two amendments. First, it allows the Office to instruct a non-Federal entity to prioritize or expedite conditions in the initial annual survey for an Indian Tribe. Second, it gives the Secretary discretion to adjust the base support funding formula to provide initial funding to a Tribe that has not received it, and requires the Secretary to provide such funding on an expedited basis, considering local conditions and factors if available, without delaying due to unavailable information. Sec. 3, Report on Barriers to Tribal Justice Services: Within 360 days of enactment, the Comptroller General must audit and report on barriers preventing Indian Tribes from accessing Tribal justice services. The report may include recommendations for timely service provision, and analysis of the Tribal court assessment and fund distribution process, whether the assessment length is necessary for initial court establishment, potential federal savings from a streamlined process, customization of assessments to Tribal jurisdictions and customs, and whether a Tribe can continue accessing funding while an assessment is pending.
