Summary

This bill expands the authority of the Federal Motor Carrier Safety Administration to assess civil penalties for violations of household goods shipping laws and regulations, and makes related changes to registration and enforcement. Sec. 2, Administrative assessment of civil penalties: The Secretary of Transportation is given authority to assess civil penalties after notice and hearing for violations of commercial regulations related to household goods shipping, and the bill applies certain enforcement provisions to the Secretary. Sec. 3, State use of grant funds for enforcement: States may use federal grant funds to enforce federal household goods laws for interstate and intrastate transportation, but this is optional and not a condition for receiving funds. Sec. 4, State retention of penalties: Any fine or penalty imposed on a carrier or broker in a state proceeding shall be paid to and retained by that state. Sec. 5, Registration requirements: The bill defines 'principal place of business' as a single physical location where management reports, business is conducted, and records are kept. Motor carriers, freight forwarders, and brokers must designate a principal place of business and disclose certain relationships with other entities from the prior three years. The Secretary may withhold, suspend, or revoke registration for failing to designate a valid principal place of business.
