Summary

This bill directs the Environmental Protection Agency (EPA) to allow electricity made from renewable biomass to generate credits under the renewable fuel program, and makes other changes. Sec. 2, Definitions: Defines key terms like 'electric utility', 'Indian Tribe', 'pathway petition', 'registration request', 'renewable biomass', 'renewable fuel program', 'State', and 'transportation fuel' by referencing existing laws. Sec. 3, Renewable electricity under the renewable fuel program: Requires the EPA Administrator to review complete pathway petitions and registration requests within 365 days, and others in a timely manner. The Administrator must publish and update quarterly a public list of pending, approved, or denied petitions and requests with key dates. The Administrator may collect fees from facility operators to cover review costs, and must refund the fee if review is not completed within 18 months, with possible waivers for state-owned utilities or Indian Tribes. The Administrator must issue a regulation within 90 days, finalized within a year, to generate credits (eRINs) for electricity from renewable biomass used as transportation fuel, specifying who can generate them, preventing double-counting, and setting data requirements. Alternatively, the Administrator can modify a prior proposed rule to include these provisions. Sec. 4, Elimination of certain restrictions on renewable biomass from forestlands: Amends the Clean Air Act to expand the definition of renewable biomass from forestlands to include trees and tree residue from all forestlands, including those held in trust for Indian Tribes, and to include slash and thinnings from all forestlands, with an exception for material from old-growth or late successional forest unless derived for restoration after a natural disturbance. Sec. 5, Federal data reporting on renewable electricity from biomass: Requires the Administrator of the Energy Information Administration to include data on electricity from renewable biomass as a separate line item in reports like the Electric Power Monthly, and to consult with the EPA Administrator. Sec. 6, Technical corrections: Makes minor amendments to the Clean Air Act to insert 'and' before 'sulfur hexafluoride' in a definition, update a provision on periodic reviews to include impacts on certain refineries and consumers, and correct a cross-reference in a section on blending reformulated gasolines.
