Summary

This bill makes any Member service performed by an individual who is expelled from Congress noncreditable for determining eligibility for or the amount of any annuity from the Civil Service Retirement and Disability Fund based on that service. It also provides for refunds of contributions, protects previously paid benefits, and requires the Office of Personnel Management to issue regulations.

Sec. 2, Provisions relating to the Civil Service Retirement System: If a Member is expelled from Congress, all their previous Member service cannot be used to calculate or qualify for an annuity under the Civil Service Retirement System. The individual can get a refund of their own contributions (minus any amounts already refunded or paid as benefits). They do not have to repay any annuity properly paid before the expulsion. This section does not override subchapter II of chapter 83. The Office of Personnel Management will write regulations.

Sec. 3, Provisions relating to the Federal Employees' Retirement System: If a Member is expelled from Congress, all their previous Member service cannot be used to calculate or qualify for an annuity under the Federal Employees' Retirement System. The individual can get a refund of their own contributions (minus any amounts already refunded or paid as benefits). They do not have to repay any annuity properly paid before the expulsion. All government contributions to the Thrift Savings Plan made while the individual was a Member, plus earnings on those contributions, are forfeited. This section does not override subchapter II of chapter 83. 'Member service' is defined as service as a Member of Congress. The Office of Personnel Management will write regulations, including for reducing or eliminating supplemental payments.

Sec. 4, Conforming amendments: Two sections of title 5 are amended to reference the new forfeiture provision for the Thrift Savings Plan.

Sec. 5, Effective date: The bill applies to any expulsion based, in whole or in part, on any act committed or conduct engaged in after the date the bill becomes law.
