Summary

This bill directs the Secretary of Health and Human Services to adjust Medicare payment rates for certain durable medical equipment (DME) items that were part of the Round 2021 DMEPOS competitive bidding program but did not have contracts executed and did not revert to unadjusted fee schedule amounts by January 1, 2021. For covered items furnished from January 1, 2024, through December 31, 2024, the fee schedule amount for an area will be 90% of the adjusted payment amount and 10% of the unadjusted fee schedule amount.

Sec. 2, Adjustments to Medicare payment for items formerly included in Round 2021: The Secretary must apply a specific transition rule so that for covered items (those competed in Round 2021 but without executed contracts and not reverted to unadjusted rates by January 1, 2021), the fee schedule amount for 2024 is 90% of the adjusted payment and 10% of the unadjusted fee schedule amount.

Sec. 3, Payment rates for DME in non-competitive bidding areas: The Secretary must apply the transition rule described in section 414.210(g)(9)(v) to all applicable items and services in areas other than rural or noncontiguous areas through December 31, 2024. The Secretary must not implement section 414.210(g)(9)(vi) until January 1, 2025. The Secretary may implement this section by program instruction or other means.
