This bill authorizes the President to sell up to two Virginia Class submarines to Australia over 15 years to support the AUKUS security partnership. Sec. 3, Authorization of sale: The President may transfer up to two Virginia Class submarines from the Navy to Australia on a sale basis within 15 years of enactment. Australia must pay all transfer costs. Repairs or refurbishments must be done at a U.S. shipyard, but can involve U.S., UK, or Australian personnel. At least 270 days before a transfer, the President must certify to Congress that the transfer won't harm U.S. undersea needs, is in U.S. interests, supports AUKUS, and that the U.S. has enough industrial capacity and uranium. Australia must provide funds and show it can host the submarines. Congress can block a transfer by passing a joint resolution within that 270-day period. Receipts from the sale can be credited to various defense accounts and used for the submarine industrial base. Transfers of nuclear material must follow the Atomic Energy Act. The President may also transfer or export defense services to Australia and the UK, including to private-sector personnel, to support the submarine industrial base. The Secretary of Defense must submit annual classified reports for 15 years on the transfer status, submarine security cooperation, production facility expansion, submarine procurement plans, and related agreements.
