This bill updates federal firearms laws to exempt certain less-than-lethal projectile devices from restrictions and taxes. It defines these devices as those not designed to expel a projectile faster than 500 feet per second and intended to not cause death or serious injury. The bill also requires annual reviews of new technologies.
Sec. 2, Exemption from firearms restrictions: The bill amends the definition of a firearm in U.S. Code to exclude a 'less-than-lethal projectile device,' which is defined as a device with a bore or multiple bores that does not expel a projectile over 500 feet per second and is designed to not cause death or serious bodily injury.
Sec. 3, Exemption from firearms and ammunition tax: The bill exempts less-than-lethal projectile devices, certain listed devices, and their shells or cartridges from the federal excise tax on firearms and ammunition. It also requires the Treasury Secretary to publish and annually update a list of qualifying devices, and a separate list of devices that would qualify except for exceeding 500 feet per second, with an annual report to Congress on the latter list. This applies to sales after the bill's enactment.
Sec. 4, Exemption from National Firearms Act: The bill amends the definition of a firearm under the National Firearms Act to exclude less-than-lethal projectile devices and devices on the list described in section 4182(d)(1)(B) of the Internal Revenue Code.
